The Federal Council states that the protection of the Swiss financial market and investors demands the introduction of general market surveillance. This will make it possible to prevent all market actors, and not only those whose behaviour runs the risk of being particularly damaging, from engaging in any behaviour connected with market manipulations. This means that in the future, organisations which have not previously been subject to Finma oversight, such as hedge funds and private investors, will now also be subject to partial surveillance by Finma. The Federal Council has also increased the maximal find for intentional violation of the obligation to declare investments. As a general rule, intentional violation of the declaration obligation involves investments in the millions of Swiss francs. The Federal Council concluded that it had sufficient grounds to increase the maximal fine for those guilty of such a penal infraction to CHF10m.

According to Z-Ben Advisors, it is the first putative authorisation after a gap of five years. The new entity would manage the portfolio of the Sino-Life group, which represented CNY28bn as of the end of 2009. In addition, Sino-Life already has a QDII license with a quota of USD9bn.

The fund will be listed on the Shenzhen stock exchange after its launch. The Bric Index fund will provide investment in companies of the S&P Bric 40 index, which includes the largest companies of the BRIC countries in the energy, materials, financial and IT sectors, including Baidu, Tencent, Lukoil, Gazprom, Infosys and Reliance.
In response to press speculation, Gartmore has confirmed that it has entered into negotiations with Henderson Group about a conditional offer by Henderson to acquire the entire share capital of the fund management company. These negotiations are on the basis of a proposal at a slight discount to the Gartmore share price at the close of trading on December 16, 2010 (98.75p). According to the Financial Times, Henderson has made a 95p per share offer. Following Gartmore’s announcement, Henderson Group has also confirmed that it is in discussions regarding a potential acquisition of Gartmore.At this stage there can be no certainty that these discussions will result in a formal offer being made for Gartmore either on these or on any other terms.

Le climat des affaires en Allemagne a atteint un nouveau plus haut depuis la réunification du pays en 1991, montre vendredi les résultats de l’enquête mensuelle de l’institut Ifo, le dynamisme croissant de l’activité domestique ayant soutenu l'économie du pays. Son indice principal, fondé sur une enquête réalisée auprès de 7.000 entreprises, a atteint 109,9 en décembre contre 109,3 en novembre, qui constituait déjà son niveau le plus élevé depuis la réunification de 1991.
Les dirigeants de l’Union européenne se sont mis d’accord pour tenter d’allonger la maturité des nouvelles émissions de titres de dette souveraine, lit-on dans le projet de conclusions du sommet de l’Union européenne, qui s’achève ce vendredi. «Les Etats membres vont s’efforcer d’allonger la maturité de leurs nouvelles émissions obligataires à moyen terme afin d'éviter des pics de refinancement», est-il précisé dans le projet, dont Reuters a pu obtenir une copie.

Le climat des affaires dans l’industrie en France s’est amélioré en décembre pour remonter à son meilleur niveau depuis la mi-2008, grâce notamment à une nette hausse des carnets de commandes, montre l’enquête mensuelle de conjoncture publiée vendredi par l’Insee. L’indicateur synthétique du climat des affaires dans le secteur manufacturier a progressé de trois points à 103.
Moody’s a annoncé avoir abaissé de cinq crans sa note souveraine attachée à l’Irlande, qui passe ainsi de Aa2 à Baa1, tout en disant que d’autres abaissements pourraient suivre si Dublin ne parvenait pas à stabiliser les paramètres de sa dette dans un avenir prévisible. Cette décision a fait grimper les rendements de dette irlandaise à 10 ans de 7,5 points de base (pdb) à 8.522%, et les spreads de dette irlandaise par rapport aux obligations allemandes se sont également creusés de 10 pdb pour atteindre 551 pdb. Dans la foulée, les spreads portugais se sont également creusés à 364 pdb et le franc suisse a touché un plus haut historique contre l’euro, qui s’est par la suite repris.

L’agence de notation explique sa décision par le passif des banques ainsi que des incertitudes accrues concernant les perspectives économiques du pays.
p { margin-bottom: 0.08in; } Companies with a high likelihood of default monitored by Moody’s (“B3 Negative and Lower Corporate Ratings”) have cumulative debt of over USD100bn that will mature between 2011 and 2015, according to a study recently published by the ratings agency. The number of companies exposed to defaults fell to 182 from a peak of nearly 300 in first half 2009. The development reflects an improvement in the quality of credit for companies in the speculative category, but many of the remaining companies will be facing significant refinancing needs. About 42% of the debt concerned has a negative outlook, while only 15% of the total has a positive outlook.
p { margin-bottom: 0.08in; } The non-governmental organisation Earthrights has published a report which blows the whistle on the Norwegisn government pension fund (NOK392bn in assets under management) for its investments in oil and gas companies with operations in Burma. According to the 40-page report by the NGO, the Norwegian sovereign fund has invested a total of about USD4.7bn in 15 oil and gas companies active in Burma. Among the guilty companies is the French firm Total, in which the Norwegian fund has invested USD1.6bn, and the US firm Chevron, with an investment of slightly over USD900m. The South Korean Posco and the Chinese CNOOC are also on the list, with investments of USD244.5m and USD168m. Among the violations the NGO finds in Burma are forced labour, murder, and expropriation of real estate. The NGO therefore recommends that the ethical council place under watch or exclude firms which violate the ethical standards set by the sovereign fund itself.

The Financial Times reports that the largest hedge fund from the firm, the Advantage Plus Fund, has made up for its poor performance in the first part of 2010. Though the fund showed a loss of 11% for the year to September, its investments have gained value in the past few weeks, largely thanks to its high exposure to gold, and its returns were +10.2% as of 10 December. One investor says that returns now total 14.3% for the year.
