Elle s"applique à l"ensemble des sociétés de gestion de portefeuille et aux prestataires de services d"investissement exerçant le service de gestion de portefeuille pour le compte de tiers."Aux termes du I de l"article R. 214-19 du code monétaire et financier, «Les organismes de placement collectif en valeurs mobilières doivent pouvoir à tout moment valoriser de manière précise et indépendante leurs éléments d’actif et de hors-bilan». Cette valorisation précise et indépendante doit permettre au prestataire de services d"investissement de respecter le principe d"égalité de traitement entre les porteurs d"un même OPCVM, énoncé à l"article 411-11 du règlement général de l"AMF, quelles que soient les circonstances de marché. Conformément au iii du b du 2° du I de l"article R. 214-13 du code monétaire et financier, les instruments financiers à terme non négociés sur des marchés réglementés «font l’objet d’une valorisation effectuée par l"organisme de placement collectif en valeurs mobilières, qui ne se fonde pas uniquement sur des prix de marché donnés par la contrepartie» et qui satisfait aux critères mentionnés audit article», énonce l"AMF dans l"article 2 de l"instruction. Sont par ailleurs précisées les procédures de valorisation et les conditions de recours à un modèle de valorisation.
Pour un montant non communiqué, le gestionnaire allemand Union Investment Real Estate (UIRE) a acheté au Grupo Marsans l’immeuble de bureaux Pórtico de Madrid (20.700 mètres carrés, 400 places de parking). L"action de Fortress Investment Group a bondi lundi sur des rumeurs selon lesquelles la société pourrait se retirer de la cote, rapporte le Financial Times. Fortress avait été la première structure de private equity et de hedge funds à s"être introduite en Bourse il y a deux ans.

The Austrian financial supervisory authority (FMA) announced on Friday that the two CEOs of Bank Medici, Peter Scheithauer and Werner Tripolt, have resigned, and that the regulator has appointed the auditor Gerhard Altenberger as the government"s representative to manage the firm, which has been damaged by the Madoff scandal, and to protect creditors of the firm. As of mid-December, Bank Medici, which is 75% owned by Sonja Kohn and 25% by UniCredit, announced that it had USD2.1bn in exposure to Madoff funds. According to Der Standard, the firm"s actual exposure runs to at least USD3.6bn, including USD2.5bn fort he Herald USA Fund, and USD1.1bn for the Thema International Fund.
According to Ahorro Corporación, assets under management in funds on sale in Spain totalled EUR176.3bn at the end of December, which represents a contraction of 29%, or EUR71.9bn. The heaviest decline affected equities funds, whose assets plunged by 69.3%, or EUR19.3bn, Expansión reports. Funds posted average losses of 2.3%; equities funds stood out with average losses of 38.3%. Short and long-term bond funds posted respective average returns of 1.8% and 2.6%, while real estate funds gained 1.7%.

For the first time since it was founded in 1590, the Hamburg-based private bank Bankhaus Joh. Berenberg, Gossler & Co. KG now has a ?spokesman for the board of directors,? who will serve as a mouthpiece and interlocutor for the other two external managing partners, Handelsblatt reports. The first holder of the office is Hans-Walter Peters, who is successor on the board to Claus-Günther Budelmann (64). Berenberg increased its staff in 2008 by more than 10%, and now has 836 personnel.
The former broker Bernard Madoff may testify before the US Congress, according to the chairman of the capital markets subcommittee, Paul Kanjorski, Les Echos reports.
Les Echos reports that the California-based bank IndyMac Bank, which has been administrated by the Federal Deposit Insurance Corportation (FDIC) since mid-July, will be taken over by a consortium of investment funds. In addition to Dune Capital Management, the consortium includes the funds Paulson & Co., JC Flowers, Stone Point Capital, Silar MCF-ILLC, SSP Offshore, and MSD Capital.
The major Wall Street establishments, such as Merrill Lynch Investment Management (before its merger with BlackRock) and Goldman Sachs Asset Management, expressed doubts about Bernard Madoff behind closed doors, the Financial Times reports. In December, securities funds on sale in Spain posted estimated net redemptions of about EUR2.37bn, according to the Inverco association of management firms. December was the eighteenth consecutive month of declining assets under management and net redemptions. The heaviest net outflows were from Santander Gestión de Activos, at EUR879m. As of 31 December, BBVA Gestión, with assets of EUR32.96bn, nearly caught up with Santander (EUR32.98bn). The number three manager is far behind the leaders: Invercaixa Gestión has only EUR11.59bn in assets.
In January-November 2008, open-ended funds on sale in Germany showed net redemptions of EUR31.34bn, according to the BVI association. But the three largest ETF providers managed to post significant levels of net subscriptions, particularly db x-trackers (Deutsche Bank), with nearly EUR10.89bn in subscriptions.
