Les Echos reports that the Securities and Exchange Commission (SEC) late yesterday indicted four individuals and a brokerage firm, which it accuses of raising several billions of dollars to supply the fraudulent investment scheme operated by Bernard Madoff. All of them acted knowingly, the US regulator claims. In a first case against the broker Cohmad Securities Corporation and two of its directors, the SEC claims that the defendants published false documents to conceal the exposure of the broker and its investors to BMIS, Bernard Madoff’s investment firm. These activities represented up to 90% of Cohmad’s revenues in some years, the SEC reports. The broker directed more than 800 accounts and billions of dollars to the financial advising services of BMIS.

A study by the Munich-based ratings agency oekom research of the social and environmental responsibility of 65 commercial banks worldwide finds that on average, these establishments receive a grade of C-, which is a rather poor result compared with other sectors. The best grades went to the German HypoVereinsBank (B-), followed by the Australian banks Westpac and National Australia Bank, with C+. In general, European and Australian banks got better grades than banks in the US and emerging countries, which scored worse. oekom research has found a net improvement as the range of sustainable development investment funds and mandates available from banks has grown, particularly in the areas of climate change and water. However, despite impressive growth, assets under management following ecological and social criteria continue to account for less than 3% of the total.
A survey by the consulting firm Creative-Research of 225 fund and pension managers in 30 countries with total assets of USD18.2trn has found that fund providers are trapped between a rock and a hard place, as capital losses and pressures on margins are increasing, on one side, while on the other, fees are remaining unchanged, Handelsblatt reports. The study “Future of Investment: The Next Move?” which will be published this Tuesday in London, shows that the gross revenues for fund managers fell by an average of 35% last year, and that participants are predicting a further decline of 15% in 2009. This requires asset managers to cut their fees. About 58% of firms surveyed have frozen their fixed salaries and tied bonuses to performance. 41% have thinned out their product ranges, and more than 60% have cut their spending on marketing and travel. Outsourcing administration and fund accounting is another measure being used at some firms. Meanwhile, though the crisis is easing, costs have not necessarily been falling. For the most part, specialists surveyed predicted that costs would increase due to toughening regulations and a rising number of legal proceedings brought by clients.

Finally, 49% of respondents have an intermediate outlook, which involves increased segmentation of producers, who will be more separate from distributors.
The technical committee of the international organisation of securities commissions (IOSCO) yesterday published its report on the regulation of hedge funds, which lays out six major principles for improved frameworks to regulate the actvities of these funds. The principles will allow regulators “to confront, in a concerted and effective manner, the systemic and regulatory risks related to the activities of hedge funds in their own jurisdictions while delivering an adapted global approach,” IOSCO says in a statement. Among the six guidelines laid out by the working group on unregulated entities are a registration requirement, not only for hedge funds or managers of hedge funds, but also obligatory registration for prime brokers and banks which lend liquidity to hedge funds.
Les Echos reports that regulators estimate that “dark pools,” which allow for blocs of shares to be traded in utter opacity, present risks of market distortion. Volumes traded in these dark liquidity pools are increasing on both sides of the Atlantic.
About 70% of asset managers and institutional investors, who have invested a total of about USD130bn in emerging markets, point to a lack of transparency about environmental, social and governance (ESG) issues as the major obstacle to investment in these countries, the agency Eiris reports. The full results of the survey will be presented on 25 June in new York at a conference entitled “Integrating ESG into Portfolios,” held by Responsible Investor and the Social Investment Forum. Respondents to the survey, however, gave good marks to Brazil and South Africa, which have made significant progress in ESG transparency. These two countries have set up sustainable development indexes in which companies which improve their communications on ESG subjects may be included.
