Manager Magazin reports that a group of partners at Sal. Oppenheim is preparing a lawsuit for conflict of interest against the directors of the bank, who, like them, are members of the owning families. The dispute is over a EUR300m loan issued by the bank four years ago to Madeleine Schickedanz, the largest shareholder in Arcandor. The loan is said to have been guaranteed by, among others, the chairman of the managing partners, Matthias, Count of Krockow, and the chairman of the supervisory board, Georg, Baron von Ullmann. The partners planning to challenge the move suspect the executives of the bank of having subsequently decided to provide massive aid to Arcandor (Sal. Oppenheim became the largest shareholder in the retail group) in order not to be personally obliged to supply funds to cover the guarantee on the loan. With the bankruptcy of Arcandor, the bank made heavy losses and will now be obliged to be acquired by Deutsche Bank.
Janus Capital Group has announced net income of USD8.2m in third quarter, a decline compared with the USD15.8m it earned in second quarter and the USD26m it made in third quarter 2008. Revenues in third quarter were 13.7% up to USD227.6m, compared with second quarter, thanks to an increase in assets under management. But expenses increased by 29.2% to USD44.8m, largely due to operating costs related to the departure of the former CEO, totalling USD32.6m. Assets under management increased in third quarter by 12.95 to USD143.1bn, from USD126.7bn in second quarter 2009. As of 30 September 2009, total assets under management at Janus came to USD151.8bn, more than the USD132.6bn as of 30 June 2009, but less than the USD160.5bn as of 30 September 2008. The rise in AUM is solely due to positive market effects, as the firm has seen net outflows of USD0.6bn. In detail, the Janus and Perkins companies saw net inflows, of USD1.3bn and USD0.6bn, respectively, but these were offset by net redemptions of USD2.5bn from the group’s affiliate Intech.

In the second quarter of its fiscal year, between July and September, Legg Mason has suffered further net redemptions, totalling USD8bn. However, liquidity funds received inflows of USD4bn. Despite this, the US asset management firm saw a 7% increase in assets under management in the period to USD702.7bn, compared with 30 June, thanks to positive market effects. This increase in assets has allowed Legg Mason to increase revenues by 8% to USD659.9m in the period. Expenses also increased 5% to USD582m, largely due to a revaluation of pay scales for the top earners at the firm. In total, net profits totalled USD45.8m, a slight decrease compared with the USD50.1m in first quarter.

Vigorous protest against the planned alternative management directive is beginning to bear fruit. According to a working document obtained by Handelsblatt, Anders Borg, the Swedish chairman of Ecofin, is said to be disposed to ease the terms of the AIFM directive concerning private equity and hedge funds. Hedge funds would be allowed to finance investments with a high degree of leverage, while clauses in the legislation limiting credit and requiring firms to disclose details of these loans would be all but completely removed from the new version of the bill. Requirements that private equity investors disclose information to regulators would also be considerably eased, as would rules governing regulatory capital.
